Switzerland's First Spot Bitcoin ETF: Why FINMA's BBIT Approval Is a Fund, Not a Note

Europe has had exchange-traded bitcoin products for years. What it has not had is a regulated fund that holds bitcoin directly and is open to ordinary retail investors. On 20 October 2026, that changed: Switzerland’s Financial Market Supervisory Authority FINMA approved the country’s first Bitcoin ETF, and Zurich-based BIT Asset Management confirmed it is the issuer of the Bitcoin Fund ETF, ticker BBIT, expected to start trading on the SIX Swiss Exchange in November.

The headline sounds like a European copy of the US spot ETFs. The more important detail is the legal wrapper.

ETP versus ETF: the distinction that matters

Most bitcoin products listed in Europe today are exchange-traded products (ETPs). As BIT’s own announcement puts it, these are debt instruments that carry issuer risk: if the issuer fails, holders are creditors, even if the product is physically backed.

BBIT is different. It is a Swiss collective investment scheme, and BIT says its assets are held separately from the fund management company and ring-fenced for investors. That is the same basic structure that let BlackRock’s iShares Bitcoin Trust and the other US spot ETFs pull bitcoin into mainstream portfolios after January 2024.

BIT describes BBIT as currently Europe’s only spot bitcoin ETF. For investors and advisers who are barred from holding debt-like ETPs, or who simply prefer fund-law protections, that is a meaningful new option.

How FINMA got there

Swiss public funds normally have to diversify. A fund that holds one asset does not fit that rule, so FINMA granted an exemption. Its stated reasons: bitcoin’s long trading history and its particularly high trading volume compared with other cryptocurrencies. FINMA classifies the product as an “other fund for alternative investments” with a specific risk.

The approval comes with strings attached:

  • Custody and operational safeguards, in line with guidance FINMA published on 12 January 2026.
  • Point-of-sale rules under the Financial Services Act (FinSA), including suitability assessments.
  • Clear risk warnings about volatility and the risk of losing money, highlighted in the fund documents.

FINMA was unusually blunt in its release: investments in bitcoin “even through an approved ETF” remain highly risky, and the capital invested “may lose a significant amount of its value.”

This is also a step up from FINMA’s earlier crypto approval. In 2021 it authorised a crypto basket fund, but only for qualified investors, as Finst notes. BBIT opens the door to the general public.

Why it matters beyond Switzerland

Three things stand out.

More are coming. FINMA said other fund providers have already submitted or announced applications for Bitcoin ETFs, so BBIT is likely the first of several Swiss-law funds.

A template for Europe. Under EU rules, single-asset crypto funds have largely been off the table for retail, which is why the market defaulted to ETPs. Switzerland, outside the EU, now has a working model showing how a regulator can permit a single-asset bitcoin fund while leaning on custody rules and suitability checks instead of outright bans.

Timing. The approval lands as bitcoin trades back above $83,000 and treasury companies keep buying. A regulated fund wrapper gives conservative Swiss banks and wealth managers an easier way to offer bitcoin exposure through an ordinary bank account, which BIT says is the goal.

What it means for Indian investors

BBIT does not change anything in India directly. Indian residents wanting foreign-listed funds generally go through the RBI’s Liberalised Remittance Scheme, which caps overseas remittances at $250,000 per financial year, and brokers offering European listings are limited. Tax treatment of foreign bitcoin fund units is also not clear-cut compared with India’s 30% tax and 1% TDS regime for directly held crypto, so anyone considering this route should speak to a tax adviser first.

The bigger signal is regulatory. India still has no domestic spot bitcoin ETF. Each major market that approves one, from the US to now Switzerland, adds to the precedent that crypto can be wrapped in familiar, supervised products with investor protections, which is the kind of framework Indian policymakers have been weighing.

The bottom line

FINMA did not just approve another bitcoin ticker. It approved a ring-fenced fund structure for retail investors, with conditions attached, and signalled more are on the way. Watch the November SIX listing, the fees BIT discloses and how quickly rival applications follow.

FAQ

What is BBIT? The Bitcoin Fund ETF from BIT Asset Management, the first Swiss-law exchange-traded fund to invest directly in bitcoin. It is expected to list on the SIX Swiss Exchange in November.

How is it different from a bitcoin ETP? ETPs are debt instruments carrying issuer risk. BBIT is a collective investment scheme whose assets are held separately from the manager and ring-fenced for investors.

Can Indian investors buy it? Possibly, via the Liberalised Remittance Scheme and a broker with SIX access, but availability and tax treatment vary, so check with your broker and a tax adviser.
