Hong Kong Will Report Your Crypto Trades From 2027. Indian Residents Sit in the Same Net

Hong Kong's new CARF law starts collecting crypto trade data in 2027. What that means for Indian residents on HK platforms.

On 4 November 2026, Hong Kong’s Legislative Council passed the Inland Revenue (Amendment) (Crypto-Asset Reporting Framework and Amended Common Reporting Standard) Bill 2026. From 2027, covered crypto service providers must collect customer and transaction data. From 2028, the Inland Revenue Department (IRD) will automatically share it with partner tax authorities.

This is not a new Hong Kong capital-gains tax. It is the OECD’s Crypto-Asset Reporting Framework (CARF) — banking-style automatic exchange of information for tokens. For an Indian resident on a Hong Kong exchange, the change is visibility, not India’s 31.2% VDA rate.

What the law requires

Per the IRD press release and its CARF page, reporting crypto-asset service providers must identify reportable users, collect name, address, residence and taxpayer ID, and report aggregated annual figures per crypto type — gross amounts, units, and counts of acquisitions, disposals and transfers, including to external wallets. They must also register on Hong Kong’s CARF Portal.

Amended CRS rules for other digital products start in 2028, with exchanges under that standard from 2029. Hong Kong has run ordinary CRS bank exchanges since 2018. CoinDesk notes buys, sells, swaps and external-wallet transfers are in scope; data goes to tax authorities, not the public.

The OECD’s Global Forum CARF commitments list (updated 14 September 2026) puts Hong Kong in the 2028 first-exchange cohort, alongside Singapore, the UAE, Switzerland and Mauritius. Forty-six jurisdictions aim for first exchanges in 2027, including the UK, Japan, Korea and most of the EU.

India sits in a footnote: identified as relevant to CARF and “in the process of making a political commitment”. That OECD snapshot is older than Hong Kong’s vote, so treat India’s formal exchange start date as not yet locked on that list, even as Indian domestic rules already require crypto reporting.

What it means for Indian investors

India already taxes VDA transfers at 30% plus 4% cess, with 1% TDS on many Indian-platform sales. Offshore books that never touch an FIU-IND exchange have been harder to see. CARF closes that gap: a Hong Kong provider reports an Indian tax resident to the IRD, which can exchange with partners once arrangements are live.

Record-keeping example only. In 2027 you buy ₹6 lakh of bitcoin, sell ₹4 lakh, and withdraw ₹2 lakh of BTC to a hardware wallet from a Hong Kong platform. CARF typically captures ID plus aggregated acquisition, disposal and transfer totals for the year — not a public hash dump. Your Indian return still uses cost, proceeds and 31.2%; the change is that an overseas ledger may sit beside your AIS.

BtcMedia verdict: Hong Kong did not invent a new crypto tax. It built a pipe. From 2027 the pipe fills; from 2028 it can talk to other tax offices. Indian residents on HK platforms should assume annual buy/sell/transfer totals will no longer stay local.

FAQ

Does Hong Kong now tax my crypto gains at a new rate? No. The 4 November law is a reporting and exchange framework (CARF), not a new Hong Kong capital-gains rate on your tokens.

When do Hong Kong exchanges start collecting the data? From 2027, with IRD automatic exchanges with partner jurisdictions from 2028, per the IRD.

Does this change India’s 30% VDA tax or 1% TDS? No. Indian rates stay as they are. CARF changes how easily authorities can compare overseas platform totals with what you declare.

How we calculated this: dates and obligations from the Hong Kong IRD press release of 4 November 2026 (HKT 17:50) and the IRD CARF page; exchange cohorts from the OECD Global Forum CARF commitments PDF last updated 14 September 2026; product scope cross-checked with CoinDesk’s 5 November 2026 report. Checked at about 9:00 PM IST on 5 November 2026.
